On February 24, 1803, the United States Supreme Court decided Marbury v. Madison. Chief Justice John Marshall's opinion in the case asserted for the first time that the federal judiciary held the power to declare a law unconstitutional. He wrote, "It is emphatically the province and duty of the judicial department to say what the law is." The copy of the document shown above shows damage from the Capitol fire in 1898.
